—In an action, inter alia, to recover damages for fraud, the plaintiff appeals from an order of the Supreme Court, Richmond County (J. Le-one, J.), dated November 9,1999, which granted the defendants’ motion to dismiss the complaint and denied, as academic, his cross motion to disqualify the defendant’s attorney.
Ordered that the order is affirmed, with costs.
