Appeal from St. Louis County Circuit Court . — Hon. John W. McElhinney, Judge. (1) The first four grounds of the motion for new trial are that the verdict is against the law and the evidence. The defendant, a negro, was convicted at the January term, 1903, of the circuit court of St. Louis county, upon a charge of rape upon the body of one Ida Andrews, and his punishment assessed at fifty years in the penitentiary. The testimony of Ida Andrews, the prosecuting witnes, was to the effect that on May 29, 1902, she was at work at the residence of one Mrs. Dawson in Webster Groves, in St. Louis county, and feeling sick at about a quarter to five o’clock in the afternoon, started for her home on Farm avenue in that town.
