On May 20, 1917, appellant Emery H. Anderson, husband of appellant Elizabeth Anderson, was the owner of certain real estate on which was a bona fide mortgage of $3,000; and on that day appellants made and constituted one Charles J. Anderson their attorney in fact to sell and convey the real estate. Pursuant to his authority the attorney in fact thereafter listed the land for sale with Falvey and Sweitzer, real estate agents, who later found that it would facilitate the sale of the land if the mortgage indebtedness thereon was increased to $5,000.
