McHUGH, Justice:

This case is before this Court upon appeal of a declaratory judgment concerning the interpretation of a will and its corresponding codicil. It arises from an order entered on April 3, 1985, by the Circuit Court of Raleigh County in which the court ruled that the testamentary instruments of Dr. Eva Teter Hammer created a life estate in the trust income of the “Eva Teter Hammer Trust” for her sister, Macie Teter Williams, and upon her death, for the testatrix’s nieces, the daughters of Macie Teter Williams, Alice Jean Enke and Anna Dean Williams.
