MOORE, Justice.
In this appeal we consider acts of fraud committed during property distribution proceedings in the Family Court. The plaintiff, Carol Schmeusser, (the “wife”), appeals a finding of the Family Court that certain misrepresentations of defendant, Lloyd Schmeusser (the “husband”), made to the Family Court, did not rise to the level of fraud. The Family Court found that certain material omissions of the defendant had occurred in violation of his duty of candor under oath. However, after applying the principles of Stephenson v.
