August 25, 1906, plaintiff Nichols, was braking on a freight train of the defendant, The Rio Grande Southern Railroad Company, and while .crossing the Dolores river, the bridge collapsed, and he; with seven freight cars and the caboose in which he was riding, was precipitated into the gulch below, severely injuring him.
