The above case is before me upon motion of the defendant “to enter Summary Judgment for the Defendant in accordance with the provisions of Rule 56 (b, c) of the Rules of Civil Procedure, 28 U.S.C.A. on the ground that the pleadings, the Affidavit hereto attached, the copy of the Complaint in Civil Action No. 2733 in this Court and the records of the Court show that the Defendant is entitled to Judgment as a matter of law because the claims for relief in both causes of action are res judicata”, and upon the further motion of the Defendant “to Dismiss the Complaint on the…
