Appeal by the defendant from a judgment of the Supreme Court, Queens County (Gavrin, J.), rendered October 27, 2008, convicting him of endangering the welfare of a child, upon a jury verdict, and imposing sentence.

Ordered that the judgment is reversed, on the law, and the matter is remitted to the Supreme Court, Queens County, for a new trial.

The defendant is the biological father of the complainant, who was raised in the Netherlands. At trial, the complainant testified that she first met the defendant in July 2002, at the age of 14, when she traveled to the United States for the first time.…
