This case comes up by a writ of error from the circuit court for the district of Ohio, to reverse a judgment in an action of ejectment, obtained by the defendants against the plaintiffs in error. The sole question in the court below, was the validity of a sale of the premises in controversy, under a judgment of the court of common pleas of Hamilton county, Ohio, in a case of foreign attachment, rendered against Seth Cutter in 1868 at the suit of Samuel Foster.
