Frederick William Heider by his next friend brought an action in the Circuit Court for Dade County against John G. Dupuis', who did business as White Belt Dairy, for damages for personal injuries sustained in an accident which in one count of the declaration is alleged to have been caused by being thrown from an automobile truck, carelessly driven by the defendant’s agent, a wheel of the vehicle passing over him.
