COXE, District Judge.
This is a suit for alleged wrongful appropriation by the defendant of an original idea for making artificial silk yarn, irregular in thickness, for use in the manufacture of fabrics simulating shantung or pongee silk.
The complaint alleges that the idea was conceived by the plaintiff prior to 1926; that it was disclosed to the defendant in the early part of 1926, pursuant to an oral agreement under which the defendant undertook not to use the idea commercially without the consent of the plaintiff; and that the defendant, without the plaintiff’s consent, has, since about…
