NICHOLLS, J.

The district court rendered a judgment of nonsuit against the plaintiff,, principally upon his pleadings, which were as follows:

He alleged that for many years previous-to April 1, 1902, he was in the employ of William W. Bierce, Limited, a corporation organized under the laws of the state of Louisiana, and domiciled in the city of New Orleans, whereof William W. Bierce is president, and C. Bierce is vice president.
