Krueger, Judge.
The offense is murder, the punishment assessed is confinement in the state penitentiary for life.
The state’s testimony, briefly stated, shows that on the 14th day of December, 1937, appellant, Warren and the deceased went from Borger to Wheeler as witnesses to give testimony in a certain case then on trial. In the afternoon they drove to Shamrock, where appellant purchased two pints of whisky.
