delivered the opinion of the court.

This appeal—a mere ramification or appendage to litigation which has claimed much time and attention from the courts of this county and state since 1882— comes to us in a record of over 5,000 typewritten pages. The printed abstract contains over 800 pages of reading matter and the briefs and arguments over 200. The extent of this matter to be examined sufficiently' excuses the delay which has postponed the decision of the case beyond that of those near it in numerical order.
