This is an appeal from a judgment of the District Court of Cass County reversing and setting aside an order of the Public Service Commission granting a special certificate of public convenience and necessity to Carl M. Hvidsten for the hauling of petroleum products. Hvidsten, who will be referred to as the applicant, sought a special certificate as a common carrier under the provisions of Section 49-1810, 1949 Supp. to RCND 1943 to furnish transportation of petroleum products in bulk in tank trucks to points and places within the State of North Dakota from Fargo and Grand Forks,…
