ERVIN, Chief Judge.
Wesley M. Walker, Jr. (Walker) brought this action against Forbes, Inc. (Forbes), publisher of Forbes magazine, alleging that Forbes infringed his copyright in a photograph by reproducing it in Forbes without his permission. The case was tried before a jury in the United States District Court for the District of South Carolina.
