Plaintiff in error is hereinafter referred to as plaintiff and defendants in error as the commission and the company respectively.

Plaintiff, who claimed an injury resulting from an accident arising out of and in the course of his employment by the company, November 29, 1926, first filed with the commission his claim for compensation about two and one-half years thereafter.
