Appeal from a decision of the General Term of the Supreme Court, in the third district, upon exceptions there heard in the first instance, ordering judgment upon a verdict in favor of the plaintiff. This action was tried at the Albany circuit, in February, 1865. On the trial it appeared that the plaintiff’s father, on the 6th of December, 1861, was the owner of a house in the city of Albany, which, with the cellar under it, was divided into several separate apartments.
