The complaint alleges these facts: The defendant Devenís, on January 27th, 1919, gave to one Anna Bagdan his promissory note for $1,000, and secured the same by a mortgage of even date. Mrs. Bagdan assigned the nofceand mortgage to William Bagdan on January 15th, 1921, and on December 17th, 1921, he assigned the same to the plaintiff, Regina Baurer. The defendant Devenís failed to pay, upon demand, the interest due on the note, or the principal; the note being conditioned upon the payment of the principal on demand.
