BELCHER, Judge.

The conviction is for passing a forged instrument; the punishment, two years in the penitentiary.

The testimony of Earl Q. Middleton, a witness for the state, shows that he knew the appellant and that he identified him at the trial as being the same person that passed a check to him on July 10, 1955, in the sum of $114.63, payable to A. W. Hughes, signed Tom L. Harpster Steel Erection Company, by Tom L. Harpster as maker, endorsed by A. W. Hughes, and drawn on the Houston National Bank, Houston, Texas.
