Maxwell, J.. On the sixteenth day of March, 1882, the district court of Lancaster county confirmed the report of a referee and rendered judgment in favor of the plaintiff and against the defendant for the sum of $135.00. Two days thereafter the attorneys for the defendant filed a motion in said court, of which the following is a copy, omitting the formal portion:
