As appears from the foregoing statement this case is an appeal from a judgment in an unlawful-detainer action. A justice of the peace entered judgment for restitution. The defendant paid the costs and appealed to- the circuit court. On appeal the facts were stipulated and found as recited in the statement preceding the opinion. The trial judge first held that the judgment must be affirmed and entered an order for such judgment.
