After a jury trial, Stanley James Oliver was convicted of kidnapping with bodily injury, rape, and aggravated assault of his former girlfriend, F. W. He appeals the denial of his motion for a new trial, arguing that his counsel was ineffective for (1) failing to subpoena Oliver’s telephone records for potential use at trial; (2) opening the door to admission of evidence of Oliver’s acquittal on prior charges; and (3) failing to request a limiting instruction on that prior bad acts evidence.
