This cause has involved several claims and several parties but only two parties are involved in the instant appeal. Filene Gallagher is third-party plaintiff. Melvin J. Spotts is third-party defendant. Gallagher won a judgment against Spotts in the amount of $5,090. Spotts’ attorney was not present when the judgment was awarded. The attorney was also absent when the trial court denied Spotts’ motion to vacate the judgment. Spotts appeals.
