Appeal from a judgment in favor of the plaintiff, entered upon the verdict of a jury, and from an order denying a motion for a new trial on the ground of the insufficiency of the evidence, made on the minutes of the court. This action was brought to recover for injury to the respondent, caused by the steamboat of the appellants running into a steam tugboat, of which the respondent was pilot, through the negligence of the persons in charge of the appellants’ boat.

There was no error in the refusal of the court to nonsuit the plaintiff; nor in the denial of the motion for a new trial made on the minutes of the court on the ground of insufficiency of evidence. There was proof sufficient, as I think, to require a submission of the case to the jury. But there is a question of law in the case, arising upon the rulings of the court, of grave import.
