Proceeding pursuant to CPLR article 78 (initiated in this court pursuant to Education Law § 6510-a [4]) to review a determination of respondent which suspended petitioner’s license to practice medicine in New York for one year with nine months of the suspension stayed.
Petitioner was charged with professional misconduct within the meaning of Education Law § 6509 (11) pursuant to the expedited procedures of Public Health Law § 230 (10) (m) (iv) (as amended by L 1986, ch 266, §26, eff July 8, 1986) by service of a notice of direct referral proceeding and statement of charges in September 1986.…
