Petitioner, the Civil Service Board of Portland, seeks judicial review of an order of the Commissioner of the Bureau of Labor and Industries (Commissioner) determining that petitioner’s removal of the complainant’s name from the fire fighter eligibility list for employment by the Portland Fire Bureau because of his age constituted an unlawful employment practice in violation of ORS 659.030. 1 Petitioner assigns numerous errors to the Commissioner’s order, but our view of the case requires consideration of only its principal contention that the Commissioner erred in concluding that the maximum…
