delivered the opinion of the court:

This was an action in contract brought by the plaintiff-appellee to recover life insurance benefits for the death of one of the plaintiff’s minor children under an alleged interim or temporary contract of life insurance and, additionally, to recover punitive damages for alleged vexatious refusal to pay, together with attorneys’ fees and interest.
