This is a suit by appellant against the city of Independence to recover a deposit of $5000 made with the city by appellant under the terms of an ordinance submitting to the voters of said city a franchise for the' furnishing and sale of artificial and natural gas. The deposit was required to insure appellant’s performance of the conditions of said ordi*159nance when ratified by the voters and accepted by the Gas Company. The ordinance was duly ratified at an election called for that purpose, the franchise thereby granted was duly accepted and the deposit was made.
