Action by the collector of new Madrid county to recover delinquent drainage ditch taxes for the years 1907, 1908, 1909, and 1910 assessed against lands owned by defendant. The petition sets out the various steps in the formation of the district, and charges that the taxes sued for are proper assessments against defendant’s lands in the district, and are delinquent, etc. The answer is a general denial, except as to the ownership of the lands described in the petition, and pleads tender of an amount less than claimed.
