The defendant was convicted by a jury of violating section 4531 of the Penal Code (escape by a prisoner committed to a state prison from a prison forestry camp). He has appealed from the judgment.

The record shows that on July 28, 1960, the defendant, an inmate of San Quentin State Prison, was transferred to Crystal Creek Conservation Camp Number 13, located approximately 21 miles from Redding, in Shasta County.
