Plaintiff Good Timez, Inc. is the owner of Club “Z”, a restaurant/night club in St. Thomas that was damaged by Hurricane Hugo in September, 1989. Good Timez commenced this action to recover on a “contents loss” insurance policy issued by defendant Phoenix Fire and Marine Insurance Company, Ltd. (“Phoenix”). 1 The action was dismissed pursuant to a settlement reached by the parties.
