Elliott v. Rising

This action was commenced by appellant in the probate court of Fremont county, Idaho, and by him appealed to the district court, where upon motion of respondent the appeal was dismissed for the reason, as stated in the order of dismissal, that plaintiff failed and neglected to perfect the same within a reasonable time after the filing of his notice of-appeal. From such order of dismissal this appeal is taken.
