Reversing.

In the year 1883 a fine was adjudged in the Pike Circuit Court against one Vandaly Francis. On September 12th, of that year, Vandaly Francis and Gf. W. Hackney were married. On March 26th, 1884, a capias issued from the office of the clerk of the Pike Circuit Court *435against Vandaly Francis, who was'arrested by the sheriff. At that time G-. W.
