LUMPKIN, Judge.

{1 Appellant Lloyd Hicks was tried by jury and convicted of Driving While Under the Influence of Intoxicating Liquor, Subsequent Offense (Count I) (47 0.8$.2001, § 11-902) and misdemeanor Driving Under Suspension (Count II) (47 0.9$.2001, § 6-308(B)) in Case No. CF-2001-29, in the District Court of Okfuskee County. The jury recommended as punishment seven (7) years in prison and a one thousand dollar ($1,000.00) fine in Count I, and six (6) months in the county jail and a five hundred ($500.00) fine in Count II.
