Affirming.

On October 14, 1925, the appellant, Dan Lacey, was indicted by the grand jury of the Campbell circuit court charged with the willful murder of Mary Massie. Upon his trial therefor at its July term, 1933, he was convicted of the crime of manslaughter and condemned to serve a sentence of eighteen years in the penitentiary.
