Appeal by plaintiffs from a judgment of the Marine Oourt of the city of New York, entered on an order of the general term of that court affirming a judgment of that court entered by direction of a judge thereof, at trial term, dismissing the complaint against the defendant Dickie. This action was brought to recover damages for injury to the plaintiff’s goods by rain, which came through the roof of a house, 144 Chambers street, ■owned by the defendant Dickie, and leased by him to the defendants Delamater, Cummings & Windsor, a portion of which premises were leased by them to, and were occupied by, the plaintiff.
