—Appeal from an order of Supreme Court, Monroe County (Bergin, J.), entered March 15, 2001, which, inter alia, granted plaintiffs motion for partial summary judgment on liability against defendants Genesee Management, Inc. and Greece Towne Mall, L.P., and granted plaintiffs motion for leave to amend the second amended complaint to include a claim for punitive damages.
It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
