WEXLER, District Judge.

Steven Briecke (“petitioner”), an inmate at the Sing Sing Correctional Facility, has brought the above-referenced action, pursuant to 28 U.S.C. § 2254, seeking a writ of habeas corpus. Petitioner was found guilty by jury verdicts on June 3, 1985 of burglary in the first degree, assault in the first degree, and grand larceny in the third degree, and was thereafter sentenced to concurrent terms of five to fifteen years and eight-and-a-third to twenty-five years for the burglary and assault, respectively, and a consecutive term of one-and-a-third to four…
