This is a prosecution against the appellee, Jesse Gallagher, before a justice of the peace of Madison township in Richland county, on a complaint filed on July 3, 1893, by Amos Snively and Jesse Matthews, charging the said Gallagher with obstructing a public road, and to recover the penalty. The proceeding was instituted under sections 71 and 74 of the act in regard to roads and bridges as found in chapter 121 of the Revised Statutes. (2 Starr & Cur. Stat. pp. 2157, 2159).
