(after stating the facts.) This appeal involves the construction of our improvement district law's relating to the assessment against the property in the district of the cost -of the improvement, and proceedings incident thereto.
Under our statutes in force prior to 1899, the cost of a local improvement was assessed against the real property in the district by an ordinance of the council levying an assessment of a percentage of the value of the property, as shown by the last county assessment, sufficient to pay for the cost.
