INTRODUCTION
The plaintiff, Roberto Rodriguez (“plaintiff’), an inmate incarcerated with the New York State Department of Correctional Services (“DOCS”), proceeding pro se, filed a complaint pursuant to 42 U.S.C. § 1988, claiming, inter alia, that defendant Dr. Joseph Tan violated his constitutional right to privacy when he conducted an examination of plaintiff in his cell in the presence of his cellmate.
