At the March term, 1940, of Putnam Superior Court there came oh to be tried the case of L. O. Benton, transferee, against J. D. Maddox, the same being an issue formed upon an affidavit of illegality filed by the defendant to the levy on certain personal property of the defendant of an execution against him in favor of the plaintiff.
