Appellee recovered a judgment against Leroy Jenkins. The assignment of errors is entitled, Lee Jenkins v. Oliver Steele. Appellee has not filed a formal motion to dismiss the appeal but in his brief points out that the name of the appellant as given in the assignment of errors and in appellant’s brief is different from that of the defendant named in the complaint and against whom the judgment appealed from was rendered.
