— This case comes here upon a writ of error to an order granting a new trial.

The Waters Realty Company, a corporation, brought an action against Miami Tripure Water Company, a corporation, to recover compensation for services rendered in finding a purchaser of certain lands owned by the defendant which it is alleged the defendant employed the plaintiff to do at the price of $280,000 and agreed to pay the plaintiff rfor 'such service a sum equal to 5% of the purchase price.
