Benjamin S. Reynolds brought an action of debt against John W. Hurst in the circuit court of Harrison county on the 6fh day of September, 1879, “ for $600.00, damages $300.00.” The defendant demurred to the declaration generally, pleaded conditions performed, on which issue was joined, and filed a-special plea in writing, to which the plaintiff demurred generally.
