— This appeal is from a judgment in an action in the court below for damages claimed by appellees against the city of Newcastle. The complaint alleges, in substance, that the appellees in the year 1907 contracted with appellant to build a portion of Race street in appellant city by grading and paving the same with brick, and by constructing cement sidewalks on either side thereof. That the appellees. proceeded to construct the street according to the contract but that before the completion of the same or during its construction, they were delayed by the failure of the city to remove certain…
