Plaintiff filed a bill for divorce. From a decree which determined that because of a prior marriage "of the defendant,' the alleged common-law marriage between plaintiff and defendant was void, and which awarded property rights to plaintiff, the defendant appeals.
The bill alleged that on or about July 10,1941, the parties, being competent to marry, made a mutual agreement to marry and held each other out as husband and wife respectively, continuously thereafter until the date of the separation of the parties, about February 6, 1947, and that the parties lived and cohabited together as husband…
