Kirby, J.,

(after stating the facts). Appellant insists that the court erred in bolding him not entitled to recover an interest in tbe profits derived from tbe sale of tbe leases taken in tbe name of appellee during bis employment. Appellant knew, when tbe contract off employment was executed, tbe kind of business Babner was engaged in and that be bad been taking oil and gas leases in 1915 and 191'6 in Faulkner County, and is now claiming an interest in leases on 3,000 acres of land taken by Babner in 1916, before his employment.
