Appellees claim, that, when Susan Jenks died, she owned the whole of the tract of fifty-five acres; appellants claim that at that time she only owned one undivided one-fifth part of the tract.
March 9,1812, Nicholas Jarrot and his wife, then of St. Clair county in the territory of Illinois, conveyed a tract of four hundred acres of land to Ann Simpson and Samuel Best, “their heirs and assigns forever.” Samuel Best died intestate August 22, 1815; Ann Simpson died testate February 2, 1827.
